Terms of Service

You may use the Services only in compliance with these Terms and all applicable laws. Access to the operations platform is provided under a separate written agreement between MegaHerd and your organization; in the event of a conflict, that agreement governs the platform.

The Services are intended for authorized organizations and professional users. MegaHerd provides software for observation, coordination, and human-led decisions. The Services are not designed for, and may not be used to enable, autonomous use of force, targeting, or any weapons function.

You agree not to:

• Use the Services for any unlawful, harmful, or unauthorized purpose.
• Attempt to gain unauthorized access to the Services or related systems.
• Interfere with or disrupt the integrity or performance of the Services.
• Reverse engineer or copy the Services except as permitted by law.
• Misrepresent your identity or authorization to use the Services.

If you are provided access credentials, you are responsible for maintaining their confidentiality and for activity under your account. Notify us promptly of any suspected unauthorized use.

The Services, including all software, content, and trademarks, are owned by MegaHerd or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted to you, no rights are transferred.

As between the parties, your organization retains ownership of the operational data it provides to the platform. MegaHerd processes that data only as needed to provide the Services and as described in the applicable customer agreement and our Privacy Policy.

The Services may integrate with third-party providers, systems, or data sources. We are not responsible for the availability, accuracy, or practices of third-party services, and your use of them may be subject to their own terms.

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. MegaHerd does not warrant that the Services will be uninterrupted or error-free.

To the maximum extent permitted by law, MegaHerd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Services. Where a separate customer agreement applies, its liability terms control.

You agree to indemnify and hold MegaHerd harmless from claims, damages, and expenses arising out of your misuse of the Services or your violation of these Terms or applicable law.

We may suspend or terminate access to the Services if you violate these Terms or to protect the Services. Provisions that by their nature should survive termination will survive.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by applicable law in the jurisdiction where MegaHerd is established, without regard to conflict-of-laws principles, unless a separate customer agreement specifies otherwise.
